
He's been dealing with big problems since our WESH 2 I-Team reports first aired three weeks ago.
In court on Wednesday, Mims admitted that he has made enough money from BioPerformance to pay off his house in full, to buy a new Hummer for $90,000 and to buy a pair of Rolex watches -- one for his wife and one for himself for $60,000.
Mims showed a different side of himself in court -- one that was more subdued and serious.
The state estimates that Mims has made approximately $5 million off of BioPerformance.
"So, you're telling me you're able to operate your entire company on 10 percent of your total revenue and it's not a pyramid? An illegal pyramid?" Assistant Texas Attorney General John Owen asked Mims.
"It is not an illegal pyramid," Mims said.

I want to respond to the insinuations and outright deceptions in regards to the BioPerformance trial. I am speaking as a very pleased distributor- not a company spokesman. Lowell Mims invested millions of $$$ up front to purchase the distributions rights for the fuel additive and built distribution and production facilities. I always received product that I ordered and received commissions checks as promised. The only barrier to receiving product and commission checks owed me is the Temporary Restraining Order that the Texas AG slapped on Bio before even holding a hearing. The AG froze all shipping of product and mailing of commission checks earned by distributors. I have several hundred $$$ sitting in the bank in Texas that I can't get to because of the Texas AG's rush to judgement. Is this even legal for those who have earned the monies?!
I am confident that the truth of this awesome company will surface in a BIG way once the next hearing is completed.
