My parents paid my start-up fee of $499 plus shipping/handling of $31.67, a total of $530.67 to be an area manager and recieve 520 pills which I did not recieve because of this lawsuit that could go on forever! I know the government is suppose to protect the citizens from scams, but I'm wondering who screwed me worse -- BioPerformance for selling me a pill that may or may not work or the government for freezing their assets in which $530.67 of it is mine that now I will probably never see again as a cash refund or product. I understand that things need to be put on hold until things get figured out, but can't the people who are owed money be reinbursed now? Technically, some of that money that is frozen is not an "asset". That money is ours (the people under the president) and in some cases was given to some people by the BioPerformance president and then (technically) taken away by the government when they froze those bank accounts and the checks bounced which cost "us" more money. Us little people cannot afford this. We got into this (blindly, perhaps) to save money!
We need a lawyer to get a class action suit going. They have my money too, plus I do have some product that I now know to be a BANNED TOXIN, and I spent an additional $500 - 700 on ads and trade shows, and signed people up who are now out their money.
OK, the deal is that AT LEAST Lowell Mims has been in trouble with states' Attorneys General before, and basically skated out with his money before the scam was discovered and the illegal MLM was closed down.
This is the situation/scenario I believe the Texas AG is trying to prove. That is, Mims and Romero planned to drain the company of most of its millions just before the pills were shown to be worthless, and the company forced to close down. (It will truly be the height of irony if they get thrown in prison because they overlooked the teeny tiny incidental that the pills are a banned poison they were shipping as non toxic, instead of being convicted of running a scam).
So where are the class action attorneys - I'll join, and I'll head up the posse to get others to join. Shouldn't be hard to prove these bozos and most of the initial bigwigs, including his most holiness DOC FOG, based on their history, were engaged in the MLM equivalent of pump and dump.
Anybody know a good class action attorney? This is a call to arms!!

They always paid on time- every week until the AG stepped in.
A lot of average joe's were hurt when their last check bounced because the AG froze the accounts- not because the money wasn't there.
The AG evidently has no regard for not only those making "the big bucks" but for those that were creating the extra $500-1000 a month that was making a difference in their lives.
Imagine getting your check on Monday (as always), depositing the check, paying bills, only to learn later in the day on Tuesday that the check would probably bounce.
